NSC PWP Aribration Settlement

After literally years of litigation, Local 3928 and Nebraska Service Center management reached agreement to settle a longstanding arbitration dating back to 2006. On January 1, 2006 under the direction of former NSC Director Greg Christian and former Acting Deputy Neil Jacobson, NSC management unilaterally implemented a Performance Work Plan (PWP) – including the current median and subjective critical elements – while refusing to provide the union with notice or opportunity to bargain the impact and adverse affects to bargaining unit employees.

The settlement agreement provides for a re-evaluation of each adjudication officer PWP that is dated January 1, 2006 to the present using the standards in place on December 31, 2005. If the officer received an outstanding rating of record, the PWP will be not be reevaluated. If the reevaluation results in a lower rating of record, the highest rating will remain in place. Management has 90 days (or May 27, 2008) to complete the recalculations and present the results to the union for verification. Hundreds of NSC officers are affected for each of the years 2006 - 2009.

As of this writing, NSC Management maintains that it has complied with the settlement agreement, yet the union has been provided no evidence to support the claim. As such, the union will proceed with a non-compliance claim provided in the settlement agreement.
