DHS/CIS –  Complainant alleges discrimination based on race and disability when his supervisor looked thru his files when he was not at work; was placed under supervisor review; his request for reasonable accommodation was denied and when he was terminated from his position as Adjudication Officer.


DHS/ICE –  Complainant alleges discrimination bases of gender when she was not selected for the positions of Deportation Officer and Supervisory Immigration Enforcement Agent. Agency filed a Motion for Summary Judgment (MSJ), opposition to MSJ filed. Agency motion denied. Hearing scheduled. Hearing held. Closing brief filed. AJ decision in favor of complainant. Complainant awarded her choice of either position retroactive to 2006, back pay with interest. Compensatory damages of $15,000.00 and attorney fees and cost. 


DHS/ICE –  Complainant alleges discrimination based on race when supervision used the “N” word when referring to the complainant. Discovery request filed.  Hearing scheduled. Case settled waiting for implementation of agreement.


 

DHS/CIS –  Complainant alleges discrimination based on her race when she was not selected for the position of permanent Center Adjudications Officer. Notice of Appeal filed. Appeal Brief filed. Awaiting OFO Decision.  


DHS/CIS – Complainant alleges discrimination based on race, sex, reprisal when terminated. Brief in support of Appeal filed with OFO. Request to Reconsider filed. Awaiting decision.  


DHS/ICE - Complainant alleges discrimination based on gender, age and reprisal when she was denied several promotions and not receiving a performance award. Depositions concluded. Case dismissed on a Motion for Summary Judgment (MSJ). Appeal Brief filed. Awaiting OFO decision. 


DHS/ICE -  Complainant alleges discrimination based on gender, age and reprisal when not given the same career advancement opportunity and when subjected to a hostile work environment. Case dismissed on a Motion for Summary Judgment (MSJ). Appeal Brief filed. Awaiting OFO decision.


 

DHS/CIS - Recently, the Local completed a settlement agreement concerning a denial of promotion where a manager clearly attempted to denigrate the qualifications and merit of a bargaining unit employee’s application, in favor of the applicant that the manager desired for the position. Although, as is common in settlements, the agency admitted no offense, the agreement promotes the employee to the pay level and career ladder the employee would have achieved had the manager not taken the actions in this case. 090612
